This is to advise that effective March 8, 2005, USCIS has
mandated a new anti-fraud fee of $500. This fee will be collected
from all employers who initiate the H-1B visa process. This
fee will not apply to H-1B visa extensions, amendments and/or
transfers. USCIS does not require an additional form for the collection of this
fee.
When sponsoring an individual who is seeking H-1B visa classification for
the first time, the employer is required to pay the $500 anti-fraud
fee. The USCIS will not accept H-1B submissions without the $500
fee. As per current guidelines, the check must be issued by the organization.
To assist with the expeditious issuance of the required check, the Immigration
Services Department will process and follow up accordingly with Accounts Payable
to obtain the check. The hiring department will need to submit completed and
signed Business Payment Form/Check Request to the Immigration Services Department
along with the H-B request form.
Please note: in the event that the applicant
pays the $500 fee directly, it will be the hiring department’s responsibility
to provide written
proof to the Immigration Services Department that they have, in a
timely manner, reimbursed the individual.
